Swiss cycling wear manufacturer Assos has filed legal action for the second time in a decade against British fast fashion e-commerce retailer Assos PLC.
The reasons for the latest claim, first reported by City AM on Tuesday morning, are unconfirmed, but the court filings seen by Cyclingnews outline Part 7 claims - essentially how to initiate a formal lawsuit in a civil court in the UK - for "breach of contract."
The contract in question, and indeed how it is alleged to have been violated, is unconfirmed. Claims are filed not only against ASOS PLC but also against '.ASOS.Com Limited" and "Assos France SAS".
The court filing states that Fladgate LLP, a London-based law firm, was directed on behalf of Assos in Switzerland. Representatives representing ASOS are not yet listed.
Cyclingnews contacted both Fladgate and Assos for further information, but neither responded at the time of publication.
The news follows a case in 2016 in which ASOS reportedly paid £2020 million to settle a trademark dispute between Swiss Assos and German menswear retailer Anson's Herrenhaus.
In that case, from 2011 to 5 years, Asos claimed that selling clothing and other fashion accessories under the asos name infringed its community's trademark.
In the first trial, we largely voted in favor of ASOS and partially revoked the Asos mark, but in the subsequent appeals court process, there was a possibility of confusion between the 2 names. Eventually, Assos settled with both Assos and Anson's Helen House, and the Guardian's report at the time stated that Assos would be restricted from selling cycle wear.
Assos is highly regarded among cyclists for the quality and performance of cycling clothing. Its products are regularly included in the Cyclingnews tech team's buying guide, and the Assos Mille GT winter jacket is among the best winter cycling jackets on the market.
The brand attracted attention with the launch of the johdah jacket in 2021, with a huge retail price of 725.00/£575.00/€650.00.
